Deposit Protection Fund

  1. Scope of protection

ABN AMRO N.V. Frankfurt Branch is affiliated with the Deposit Protection Fund of the Association of German Banks. In accordance with its statutes, subject to the exceptions provided for therein, the Deposit Guarantee Fund shall guarantee deposits, i.e. balances arising in the course of banking operations from amounts remaining in an account or from intermediate positions, which are to be repaid by the bank in accordance with the applicable conditions.

 

Among other things, deposits that are part of the bank's own funds, liabilities arising from bearer and order bonds, as well as deposits of credit institutions within the meaning of Article 4 (1) no. 1 of Regulation (EU) No 575/2013, financial institutions within the meaning of Article 4 (1) no. 26 of Regulation (EU) No 575/2013, investment firms within the meaning of Article 4 (1) no. 1 of Directive 2004/39/EC and local authorities are not protected.

 

Deposits from creditors other than natural persons and foundations with legal capacity are only protected if:

    • the contribution is not a liability arising from a registered bond or a promissory note loan, and
    • the term of the contribution does not exceed 18 months. The maturity restriction does not apply to deposits that already existed before 1 January 2020. After 31 December 2019, the grandfathering pursuant to the preceding sentence shall cease to apply as soon as the contribution in question becomes due, can be terminated or can otherwise be reclaimed, or if the contribution is transferred by way of individual or universal succession.

Banks' liabilities that already existed before 1 October 2017 shall be secured in accordance with and subject to the provisions of the Statute of the Deposit Protection Fund in force until 1 October 2017. After 30 September 2017, the grandfathering pursuant to the preceding sentence shall cease to apply as soon as the liability in question becomes due, can be terminated or otherwise reclaimed, or if the liability is transferred by way of individual or universal succession.

The Deposit Protection Fund only provides compensation payments if and to the extent that the deposits exceed the guarantee limit of any home country deposit insurance. The scope of any home country deposit insurance can be queried on the Internet on the website of the relevant protection scheme, the address of which will be provided by the bank on request.

  1. Safeguarding Limits

The security limit will be disclosed to the customer by the bank upon request. It can also be queried on the Internet at www.bankenverband.de.

  1. Applicability of the Statute of the Deposit Guarantee Fund

For further details of the protection, reference is made to § 6 of the Statute of the Deposit Protection Fund, which is made available on request.

  1. Subrogation of claims

To the extent that the Deposit Protection Fund or a person commissioned by it makes payments to a customer, the latter's claims against the Bank shall be transferred to the Deposit Protection Fund in the corresponding amount, together with all ancillary rights.

  1. Provision of information

The Bank shall be entitled to provide the Deposit Guarantee Fund or any of its agents with all necessary information and documents in this context.

Ombudsman procedure

The bank participates in the dispute resolution procedure of the consumer arbitration board "Ombudsman of Private Banks" (www.bankenombudsmann.de). There, the consumer has the option of calling on the ombudsman of the private banks to settle a dispute with the bank. If the subject matter of the complaint concerns a dispute over a payment service contract (Section 675f of the Civil Code), customers who are not consumers can also appeal to the Ombudsman of Private Banks. Further details are regulated in the "Rules of Procedure for the Arbitration of Customer Complaints in the German Banking Industry", which can be made available on request or on the Internet at www.bankenverband.de. The complaint must be submitted in text form (e.g. by letter, fax or e-mail) to the Customer Complaints Office at the Association of German Banks, P.O.
